These Terms and Conditions are entered into by and between you and Loggerhead Reciprocal Interinsurance Exchange (“LRIE”), Loggerhead Risk Management, LLC (“LRM”), and our subsidiaries and affiliates (collectively, “Loggerhead,” “Loggerhead Insurance,” “Company,” “we,” “our,” or “us”). By accessing or using this website, including any content, forms, applications, portals, tools, or services available through the website, you agree to be bound by these Terms and Conditions.
These Terms and Conditions govern your access to and use of the website and should be read together with Loggerhead’s Privacy Policy, Cookie Policy, and any other notices, disclosures, agreements, or policies that apply to your relationship with Loggerhead. These Terms and Conditions do not modify or replace any insurance policy, endorsement, binder, contract, application, privacy notice, consumer notice, or other agreement between you and Loggerhead.
By accessing, browsing, submitting information through, or otherwise using the website, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them. Your use of certain website functions or services may also be subject to additional notices, disclosures, consents, or agreements presented at the time you use those functions or services.
Modifications to These Terms and Conditions
Loggerhead reserves the right to modify, update, revise, replace, or otherwise change these Terms and Conditions at any time, in whole or in part, at its discretion and as permitted by applicable law. No Coverage Created by Website Use

Using the website, submitting information, requesting a quote, submitting an application, making a payment, uploading a document, sending a message, or otherwise communicating with Loggerhead online does not, by itself, create, bind, issue, change, renew, cancel, reinstate, or guarantee any insurance coverage.
Insurance coverage exists only when Loggerhead or an authorized representative issues a policy, endorsement, binder, renewal, or other authorized written confirmation of coverage, subject to underwriting approval, premium payment, applicable law, and the terms, conditions, limitations, and exclusions of the issued policy.
If website content conflicts with an issued policy, endorsement, binder, renewal, or other authorized written agreement, the applicable policy or written agreement will control.
Policy Documents Control
Any insurance policy, endorsement, declaration page, renewal, notice, billing document, claims communication, or other authorized insurance document issued by Loggerhead constitutes the controlling statement of coverage, rights, obligations, and applicable terms and conditions.

Quotes, Applications, and Information Accuracy
Loggerhead may make online tools available to request quotes, submit applications, upload documents, check application status, request service, or communicate about insurance-related matters. Any quote, premium estimate, eligibility indication, application status, underwriting request, or other information displayed or provided through the website is preliminary, subject to review and verification, and may change based on the information submitted, underwriting review, property characteristics, risk factors, inspection results, consumer reports or insurance support information obtained as permitted by law, payment status, applicable law, and Loggerhead’s eligibility and underwriting requirements.
You are responsible for ensuring that all information you provide is accurate, complete, and current. Loggerhead may rely on information submitted through the website to evaluate eligibility, prepare or process quotes, process applications, verify information, issue policies, request additional documentation, service accounts, support underwriting, handle billing and payments, or support policy and claims-related activities. Inaccurate, incomplete, outdated, misleading, or fraudulent information may affect eligibility, pricing, underwriting decisions, policy issuance, renewal, cancellation, claims handling, or other insurance-related determinations, subject to applicable law and the terms of any issued policy.
All applications for insurance coverage are subject to underwriting review and approval. Submission of an application does not guarantee eligibility, pricing, coverage, or issuance of a policy.
Loggerhead reserves the right to correct errors, omissions, inaccuracies, misstatements, or incomplete information at any time, including after a quote, application, payment, policy document, communication, or account update has been displayed or submitted, subject to applicable law and the terms of any issued policy. Website information does not replace the terms of an issued policy or written agreement. If there is a conflict, the applicable policy or written agreement will govern.
Information submitted through the website may be collected, used, disclosed, verified, retained, or otherwise processed as described in Loggerhead’s Privacy Policy, Notice of Insurance Information, and other applicable privacy notices.
Claims are handled in accordance with the applicable issued policy, endorsements, applicable law, required notices, and Loggerhead’s claim-handling procedures. Information submitted through the website may be used to evaluate, investigate, process, communicate about, or otherwise support a claim, but website submission alone does not establish coverage, liability, damages, or entitlement to payment.
Account Access and Security
If you create, receive, or use login credentials, account access, portal access, verification codes, multi-factor authentication, or other authentication methods to access secure portions of the website, you are responsible for maintaining their confidentiality and taking reasonable steps to prevent unauthorized access. Loggerhead may suspend, restrict, disable, or require additional verification for account access when it reasonably suspects unauthorized activity, a security risk, misuse, inaccurate credentials, or a violation of these Terms and Conditions. Loggerhead is not responsible for losses arising from your failure to reasonably protect your credentials or secure your account access, except as required by applicable law.
Account Information
You are responsible for providing accurate, complete, and current information when creating or using an online account, submitting forms, updating account details, requesting services, or communicating with Loggerhead through the website or related portals. This may include contact information, property information, policy information, billing details, claim information, and other information reasonably necessary to support insurance-related services.
Loggerhead may rely on account information to provide website services, process requests, verify identity, communicate with you, support underwriting, administer policies, manage billing and payments, handle claims, provide customer service, meet legal or regulatory obligations, and protect against fraud, misuse, or unauthorized activity. Loggerhead may request additional information, correct obvious errors, restrict account changes, or require additional verification when information appears inaccurate, incomplete, unauthorized, or suspicious.
Account information shown through the website or a portal is provided for convenience and may not reflect all policy terms, endorsements, notices, billing activity, claims activity, underwriting decisions, or legally required communications. If account information conflicts with an issued policy, endorsement, binder, renewal, billing notice, claim communication, or other authorized written agreement, the applicable policy document or written communication will control.
Electronic Communications
By providing your contact information through the website or other Loggerhead-related channels, you agree that Loggerhead may contact you regarding your inquiry, application, quote, policy, claim, account, payment, or requested service, subject to your communication preferences and applicable law. Electronic and other communications may include email, website notices, portal messages, telephone calls, electronic document delivery, or other lawful communication methods.
This section does not, by itself, constitute consent to receive marketing text messages, automated marketing calls, or prerecorded marketing calls. Where consent is required by applicable law, Loggerhead will request the applicable consent through a separate disclosure, selection, or other affirmative action.
Where applicable, electronic delivery of insurance policies, notices, disclosures, and related records may be governed by Loggerhead’s Electronic Document Delivery Agreement or other electronic delivery disclosures presented to you.
Mobile Text Messaging
Where you provide the required consent or otherwise request or authorize mobile text messaging, Loggerhead may send mobile text messages, including SMS, MMS, RCS, or other mobile text communications, to the mobile number you provide. Messages may relate to quotes, applications, policies, billing, claims, underwriting, account service, customer support, alerts, one-time security or verification codes, and other communications you request or authorize. Loggerhead may also send marketing messages related to Loggerhead products or services where you have separately and affirmatively consented to receive them.
Consent to receive recurring or marketing mobile text messages is not required to purchase insurance, obtain coverage, or receive services from Loggerhead. Message and data rates may apply depending on your agreement with your wireless carrier.
Consenting to Text Messaging
You may opt in to receive text messages by selecting a mobile text messaging consent option on an approved Loggerhead form, submitting your mobile number through an approved Loggerhead process that includes the applicable text messaging disclosure, responding affirmatively to a mobile text messaging prompt, requesting a one-time passcode, or otherwise providing the consent required for the applicable Mobile Text Messaging Program. Loggerhead may use the mobile number you provide to send messages consistent with the program and disclosures presented at the time of opt-in.
Requesting a one-time passcode does not, by itself, enroll you in recurring or marketing text messages. One-time passcodes are transactional messages used for verification or authentication purposes. Marketing text messages will be sent only when you have separately and affirmatively consented to receive them, and you may withdraw consent to recurring text messages at any time as described in the Opt-Out Instructions section.
Mobile Text Message Service
The Loggerhead Mobile Text Messaging Program may include one-time passcodes used for identity verification or account authentication, insurance quote follow-up, application assistance, policy servicing, billing and payment communications, claims-related communications, underwriting, customer support, account or service alerts, and other account-related communications you request or authorize. Marketing text messages may also be included where you have separately and affirmatively consented to receive them.
One-time passcode messages are transactional and are sent when you initiate or request an authentication or verification process. These Mobile Text Messaging Terms govern text messages only. Providing a telephone number may also allow Loggerhead to contact you by telephone regarding a policy, billing matter, claim, underwriting matter, service request, or other account-related matter, subject to applicable law.
Message Frequency
Message frequency varies based on the type of communication, your interactions with Loggerhead, and the Mobile Text Messaging Program you selected or authorized. The frequency of one-time passcode messages depends on the number of authentication or verification requests you initiate.
Opt-Out Instructions
You may opt out of recurring text messages at any time by replying STOP to a Loggerhead text message. Loggerhead may also recognize other reasonable opt-out methods as required by applicable law. After receiving an opt-out request, Loggerhead may send one final non-marketing confirmation message acknowledging that your request has been received. Loggerhead will process the request within the period required by applicable law, and you will not receive further messages from the applicable Mobile Text Messaging Program unless you opt in again.
The scope of an opt-out request will be applied as required by applicable law and based on the communication to which you responded. Opting out of mobile text messages does not unsubscribe you from communications sent through other channels or prevent Loggerhead from sending notices required or permitted by law.

Mobile Information Privacy & Retention
Loggerhead does not sell or rent customer mobile information, including mobile phone numbers and mobile text message opt-in or consent records. Loggerhead does not share customer mobile information with third parties or affiliates for their own marketing or promotional purposes.
Mobile information may be disclosed to service providers that support the Mobile Text Messaging Program and related services, including message delivery, platform administration, customer service, troubleshooting, compliance support, and opt-out management. These service providers are authorized to use the information only to perform services on Loggerhead’s behalf. Mobile information may also be disclosed as permitted or required by law, regulation, legal process, governmental request, or an approved business function.
Loggerhead maintains safeguards designed to protect mobile text messaging-related information from unauthorized access, loss, misuse, alteration, or disclosure. However, no system or transmission method can be guaranteed to be completely secure.
Loggerhead may retain mobile phone numbers, message records, opt-in and consent records, opt-out requests, and related mobile text messaging information as reasonably necessary to operate the Mobile Text Messaging Program, provide customer service, demonstrate compliance, resolve disputes, maintain appropriate business records, and satisfy legal or regulatory obligations. When the information is no longer needed and retention is no longer required, Loggerhead will securely dispose of, delete, de-identify, or otherwise manage the information in accordance with applicable record-retention and information-security procedures.

Loggerhead’s collection, use, disclosure, protection, and retention of personal information is described in our Privacy Policy and other applicable privacy notices. The Privacy Policy explains the categories of information Loggerhead may collect, the purposes for which the information may be used, the circumstances under which information may be disclosed, applicable consumer choices and rights, and Loggerhead’s general security and retention practices.

Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, severability, and related provisions, will continue to apply to the fullest extent permitted by law.
Governing Law and Dispute Resolution
These Terms and Conditions and any dispute arising from or relating specifically to your access to or use of the website will be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law rules that would require the application of another state’s laws.
Unless otherwise required by applicable law, any legal action or proceeding relating specifically to these Terms and Conditions or the website must be brought in a state or federal court located in Delaware, and you consent to the jurisdiction and venue of those courts.
This section does not modify or replace the governing law, venue, dispute-resolution requirements, regulatory rights, or other provisions of any issued insurance policy, endorsement, binder, subscriber agreement, or other written agreement with Loggerhead. Nothing in this section limits any right or remedy that cannot lawfully be waived, restricted, or modified.
Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or modified only to the extent necessary to make it valid and enforceable. The remaining provisions will continue in full force and effect.
